These terms and conditions govern Your access to and use of the Site. By accessing and using the Site You agree that You have read and accept these terms and conditions and that they shall apply to Your use. If You do not wish to be bound by these terms and conditions, please leave the Site. Specific attention is also drawn to the Copyright Notice below.

1. Definitions

"Host Organisation" is an organisation that has registered with the Site, has been approved by the Site administrator, is publicly viewable on the Site and can submit volunteer positions to the Site.

"Registered User" is an individual or organisation that has completed the registration process on the Site.

"User" means anyone who chooses to access this Site and for the avoidance of doubt includes a Registered User and a Host Organisation.

"Volunteer" is anyone that has applied for at least one assignment regardless of his/her acceptance status.

"WWH" means Worldwide Helpers (U.K. Registered Charity Number 1117253) of Flat 4, 5 Brechin Place, London SW7 4QB.

"You/Your" means a User of this Site

2. Copyright Notice

Unless expressly stated the copyright and other intellectual property rights (such as, design rights, trademarks, patents etc.) in any material provided on this Site remains the property of WWH (or as the case may be another rightful owner). WWH owned material on this Site including text and images, may not be printed, copied, reproduced, republished, downloaded, posted, displayed, modified, reused, broadcast or transmitted in any way, except for the User's own personal non-commercial use. Permission for any other type of use must be obtained from the Site administrator at info@worldwidehelpers.org.

3. General

3.1 WWH reserves its exclusive right in its sole discretion to alter, limit or discontinue the Site or any Content (as defined below) in any respect. WWH shall have no obligation to take the needs of any User into consideration in connection therewith.

3.2 WWH reserves the right to deny in its sole discretion any User access to this Site or any portion thereof without notice.

3.3 No waiver by WWH of any provision of these terms and conditions shall be binding except as set forth in writing and signed by its duly authorised representative.

3.4 WWH maintains this Site free-of-charge. WWH grants permission to Users, to visit the Site and upload, download and copy the information, documents and materials (collectively, "Content") from the Site for the User's personal, non-commercial use without any right to resell, redistribute, compile or create derivative works therefrom, subject to these terms and conditions, and also subject to more specific restrictions that may apply to specific material within this Site. The use of the Content on any other site or in a networked computer environment for any purpose is prohibited.

4.1 WWH has prepared this Site responsibly and carefully, but disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the information on this Site or on other linked websites or on any subsequent links.

4.2 WWH makes no warranty as to the Content or the accuracy, timeliness or completeness of the Content or any information on the Site or that the Content or any information may be relied upon for any reason and WWH bears no responsibility for the accuracy, content or legality of any linked site or for that of any subsequent links. WWH makes no warranty that access to the Site will be uninterrupted or error-free or that any defects can be corrected.

4.3 All projects listed on this Site may be changed or cancelled without notice at any time by the relevant Host Organisation. It is Your sole responsibility as a User to verify the details of the Content, any projects and or any information with a relevant organisation or Host Organisation.

4.4 You agree to join a project and or organisation at Your own risk. WWH shall not be liable for any losses or damages (including without limitation consequential loss or damage) whatsoever from the use of, or reliance on, the information on this Site, or from the use of the Internet generally. Any links to other websites do not constitute an endorsement or an approval by WWH of any products, services, policies or opinions of an organisation or individual.

4.5 The User-submitted Site Content reflects the submissions of the Users of the Site and does not represent the views of WWH. WWH does not represent or endorse the accuracy or reliability of any advice, opinion, statement, communication or other information provided by any User. Reliance upon any such advice, opinion, statement, communication or other information shall be at Your own risk. Neither WWH, nor any of its respective agents, employees, information providers or content providers shall be liable to any User or anyone else for any inaccuracy, error, omission, interruption, timeliness, completeness, deletion, defect, failure of performance, computer virus, communication line failure, alteration of, or use of any content herein, regardless of cause, for any damages resulting therefrom.

4.6 WWH cannot and does not confirm that each User is who he or she claims to be. WWH is not and cannot be involved in User-to-User dealings or control the behaviour of participants on the Site. In the event that You have a dispute with one or more Users, You release WWH and its agents and employees from any claims, demands, and damages actual and consequential, direct and indirect or every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

4.7 You are responsible for Your own communications and are responsible for the consequences of their posting. You specifically acknowledge and agree that WWH is not liable for any conduct of any User.

4.8 Use of any password-protected area of the Site is restricted to the Registered User who has registered or otherwise been given permission and a password to enter such area. The password cannot be distributed to third parties. You are responsible for maintaining the confidentiality of Your information and password. You shall be responsible for all uses of Your registration, whether or not authorised by You. You agree to immediately notify WWH of any unauthorised use of Your registration or password.

4.9 WWH acts as a passive conduit for the online distribution and publication of User-submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by Users. If notified by a Registered User of communications which allegedly do not conform to these terms and conditions, WWH may investigate the allegation and determine in good faith and in its sole discretion whether to remove or request the removal of the communication. WWH has no liability to Users for the performance or non-performance of such activities. WWH reserves the right to expel Users, and prevent their further access to the Site for violating the terms and Conditions or any applicable law and the right to remove communications, which are abusive, illegal, or disruptive. WWH may take any action with respect to User-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability or embarrassmet for WWH.

4.10 As a condition of use of this Site, You agree to indemnify WWH and its affiliates from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of Your use of this Site, including without limitation any claims alleging facts that if true would constitute a breach by You of these terms and conditions. If You are dissatisfied with any material on this Site or with any of these terms and conditions, Your sole and exclusive remedy is to discontinue using this Site.

4.11 This Site may be used for lawful purposes consistent with these terms and conditions for Volunteers and Host Organisations. This Site may contain bulletin boards, access to mailing lists or other message or communication facilities (collectively, "Forums"). You agree to use the Forums only to send and receive messages and material that are proper and related to a particular Forum. By way of example, and not as a limitation, You agree not to do any of the following:

a. defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;

b. publish, post, distribute or disseminate any incomplete, false or inaccurate biographical information or information which is not Your own accurate resume or any defamatory, infringing, obscene, indecent or unlawful material or information;

c. post any franchise, pyramid scheme, club membership, distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, commission only payment, requires recruitment of other members, sub-distributors or sub-agents;

d. upload or attach files that contain software or other material protected by intellectual property rights (or by rights of privacy of publicity) unless User owns or controls the rights thereto or has received all consents as may be required by law;

e. upload or attach files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer, service to any User, host or network, or use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any activity being conducted on this Site, including, without limitation, via means of submitting a virus to any site, overloading, flooding, spamming, mail bombing or crashing;

f. delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded or delete or revise any material posted by any other person or entity;

g. falsify the origin or source of software or other material contained in a file that is uploaded;

h. send unsolicited e-mails, advertise or offer to sell any goods or services, or conduct or forward surveys, contests, or chain letters, or download any file posted by another User of a Forum that You know, or should know, cannot be legally distributed in such manner; or

i. violate or attempt to violate the security of the Site, including without limitation (i) accessing data not intended for such User or logging into a server or account which the User is not authorised to access, (ii) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation, or (iii) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.

4.12 You acknowledge that all Forums are public and not private communications. It is important not to include any personal information in Your posting (i.e. names, email addresses, phone numbers or home addresses). Further, You acknowledge that chats, postings, conferences, emails and other communications by other Users, are not endorsed by WWH, and such communications shall not be considered reviewed, screened, or approved by WWH.

4.13 WWH reserves the right for any reason to remove without notice any contents of the Forums including without limitation email and bulletin board postings.

5. Linking to our site

5.1 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

5.2The website from which You are linking must be approved in writing by WWH.

5.3 You must not establish a link from any website that is not owned by You.

5.4 The Site must not be framed on any other site, nor may You create a link to any part of the Site other than the home page. WWH reserve the right to withdraw linking permission without notice.

The designations "developed" and "developing" regions are intended for statistical and analytical convenience and do not necessarily express a judgement about the stage reached by a particular country or area in the development process.

7. Preservation of Immunities

Nothing herein shall constitute or be considered to be a limitation upon or a waiver of, express or implied, the privileges and immunities of the United Nations, including WWH, which are specifically reserved.

8. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales under the exclusive jurisdiction of the courts of England and Wales. Those who choose to access this Site from outside the United Kingdom are responsible for compliance with local laws if and to the extent local laws are applicable.
