In these Terms and Conditions the definitions shall have the meaning shown in the glossary.

Glossary
 
(a)   “Content” refers to any user generated content posted, attached or added to the
        Website including but not limited to any commentary, emails, information, blogs,
        forums,   screenshots, photographs, pictures, videos, text and artwork.
(b)    “House Rules” refers to the house rules that form part of these Terms and Conditions.
(c)    “Opportunity”, “Opportunities” or “Project” refer to any volunteering activities (including
        but not limited to projects and events) offered to users on the Website through a
        Provider.
(d)    “Providers” refers to organisations volunteering activities available to users through the
        Website.
(e)    The “Privacy Policy” refers to the privacy policy that forms part of the Terms and
        Conditions.
(f)    “Volunteering Network” and “Network” refers to the Worldwide Helpers website, a
       volunteering network run by WWH and facilitated through the Website (through which
       Providers can offer and arrange Opportunities for you).
(g)    “Profile” refers to any profile you create during your use of the Website.
(h)    “Terms and Conditions” refers to these Terms and Conditions, including the House
       Rules and Privacy Policy as updated or amended from time to time.
(i)    “WWH”, “our”, “we” or “us” refer to Worldwide Helpers (registered charity number
       1117253)

1.    Introduction

If you use the Website, you must comply with these Terms and Conditions.
Although you must read these Terms and Conditions in full, we think the most important points for you are:
(a)    You must be over 16 or over or have parental consent to view or use the Website.                                You can only create a Profile and participate in Opportunities if you are over 16.
(b)    You must comply with our House Rules when you contribute Content to the Website.
(c)    The Provider websites are independent from us, and we have no control over the
        Opportunities they offer. WWH is therefore not responsible and can accept no liability
        for the Opportunities.
(d)    Just because an Opportunity is shown on the Website, does not mean it is available.
(e)    We will only share the information you provide to us with other people or
        organisations in accordance with our Privacy Policy. We will do this, even if you have
        opted for a private Profile.
(f)     If you do not want the Content you contribute to the Website to be made publicly
       available on the Website for other users to see, you can select a private Profile.
2.     Website Use
(a)    Except as permitted in these Terms and Conditions, you may not alter the Website in
        any way or do anything that might or will damage or disrupt the good working order of
        the Website or our equipment or software.
(b)    You agree that WWH may at any time and without prior notice to you replace or
        amend these Terms and Conditions.  Your continued use of this Website after
        amendments are made means you accept the Terms and Conditions as updated.
        You should therefore visit this page regularly to review the Terms and Conditions.
(c)    You must be over 16 or over or have parental consent to view or use the Website.      You must be 16 to create a Profile and/or participate in an Opportunity.
(d)    You must keep secret any password you have and not let any other person or
        organisation use it. You must notify us immediately of any suspected misuse of your
        password.

3.     Accuracy

(a)    WWH does not guarantee that the information contained in the Website is accurate,
        verified or complete. WWH accepts no liability if you or any person or organisation
        relies on or uses the information.
(b)    WWH does not guarantee that the Website will be uninterrupted or error free, or that
        the Website or your use of it will be free of viruses or harmful material.  You are
        responsible for ensuring that your computer is suitable to use the Website.

4.     Information you provide to us

(a)    You agree that any information you provide to us is true.
(b)    Any information you provide to us through the Website will be treated in accordance
        with our Privacy Policy.

5.     Online materials

Where content on the Website is supplied by others we do not control or endorse such content in any way.

6.    Copyright and monitoring

The content of the Website is owned by WWH or third parties.  No content from the Website may be copied, used or reproduced without our written consent, except where it is used for research and non-commercial use where no consent is required. 7.    Linked sites and Providers

(a)    When you access any other website through the WWH Website (including Provider
        websites) you understand that it is independent from WWH and that we have no
        control over that website, or the services offered through it.
(b)    Where an Opportunity is posted on the Website, we cannot guarantee that it will be
        available and WWH has no control over its availability.

8.     Liability

(a)    In circumstances where you suffer loss or damage arising out of or in connection with
        the use of the Website, we accept no liability.
(b)    WWH accepts no responsibility for any loss or damage caused or alleged to be
        caused by your participation in an Opportunity. Any concerns or complaints regarding
        any Opportunity should be directed to the Provider.
(c)    WWH shall not be liable for any loss or damage caused or alleged to be caused by
        your use of another website or resource.  Any concerns regarding any external link
        should be directed to info@worldwidehelpers.org immediately.
(d)    As a condition of use of this Site, You agree to indemnify WWH and its affiliates from
        and against any and all actions, claims, losses, damages, liabilities and expenses
        (including reasonable legal fees) arising out of Your use of this Site, including without
        limitation any claims alleging facts that if true would constitute a breach by You of
        these terms and conditions. If You are dissatisfied with any material on this Site or
        with any of these terms and conditions, Your sole and exclusive remedy is to
        discontinue using this Site.
(e)    WWH cannot and does not confirm that each User is who he or she claims to be.
        WWH is not and cannot be involved in User-to-User dealings or control the behaviour
        of participants on the Site. In the event that You have a dispute with one or more
        Users, You release WWH and its agents and employees from any claims, demands,
        and damages actual and consequential, direct and indirect or every kind and nature,
        known and unknown, suspected and unsuspected, disclosed and undisclosed,
        arising out of or in any way connected with such disputes.

9.     General

(a)    We may assign, transfer, replace WWH or subcontract any or all of our rights and
        obligations under these Terms and Conditions at any time.
(b)    If any term of these Terms and Conditions is illegal, invalid or unenforceable for any
        reason, the remaining terms shall continue to be valid.
(c)    These Terms and Conditions and your use of the Website are governed by the laws of
        England and Wales and you are subject to the exclusive jurisdiction of the courts of
        England and Wales.
(d)    Except in respect of a payment obligation to WWH, neither you nor WWH will be
        held liable for any failure to perform any obligation to the other due to causes beyond
        your reasonable control.
(e)    Failure or delay by either party to enforce an obligation or exercise a right under these
        Terms and Conditions shall not be a waiver of that obligation or right.
(f)     Except where Providers are provided with rights under these Terms and Conditions,
        these Terms and Conditions do not confer any rights on any person or party (other
        than you and/or us) pursuant to the Contracts (Rights of Third Parties) Act 1999.

10.    Notices

10.1       All contact or notices to be given in relation to these Terms and Conditions or
             your use of the Website shall be given:
10.1.1    to us via e-mail to info@worldwidehelpers.org or
10.1.2    to you, via these Terms and Conditions or  at the email address you provide when
             creating your Profile (or later update).
10.2       Notice will be deemed received when an e-mail is received in full.

House Rules

If you upload any Content to the Site, you agree to accept the following house rules at all times:
(a)    You must not post or upload any Content or use the Website in a way that breaches
        any law.
(b)    You must not post or upload any Content or use the Website in a way that is
        offensive, threatening, defamatory, vulgar, obscene, harassing, false, misleading or
        unreliable, or that brings or is likely to bring the Website or WWH into disrepute. 
(c)    You agree to not contribute Content that will infringe another user’s, organisation’s or
        person’s rights (including rights of privacy or publicity).
(d)    Neither WWH nor any Provider moderates any Content posted to the Website. WWH
        accepts no responsibility for any Content, but reserves the right to remove/edit any
        Content at any time.
(e)    You are wholly responsible for all Content posted by you on the Website and for
        materials (including but not limited to emails) sent by you in connection to the
        Website.
(f)     Please let us know immediately by contacting us at info@worldwidehelpers.org if any
        of these rules are broken by you or other users, or if you have any concerns about
        material posted to the Website.
(g)    Using your access to the Website to send unsolicited bulk email or spam is
        forbidden.
(h)    We and/or any Provider reserve the right to suspend or terminate your access to the
        Website immediately at any time.
(i)     We and/or any Provider reserve the right to edit, or require you to edit, Content posted to the Website at any time.
(j)     Any Content you post to the Website may be used by WWH for any purpose subject
        to our Privacy Policy.
(k)    If your use of the Website, uploading of Content or breach of these Terms and
        Conditions creates losses for WWH, you will compensate WWH for all its losses
        (including direct and indirect losses, all costs and damages).
(l)      If your access to the Website is terminated or suspended for any reason, you must
         not access the Website or any other WWH website or create a new Profile without
         our prior consent.
